1904.07(d)    Invalidation Resulting from Expungement Proceedings

Invalidation may occur due to expungement proceedings instituted by the Director upon petition or upon the Director’s initiative, under Section 16A of the Trademark Act, because the mark has never been used in commerce on or in connection with some or all of the goods or services in the registration. See 15 U.S.C §1066a. If the Director issues an order cancelling the registered extension of protection, the USPTO will cancel the registration in due course. See TMEP §1716.04(e) regarding cancelling the registration.

After cancellation, the USPTO will notify the IB that the registered extension of protection to the United States has been invalidated. See TMEP §1904.07(e) regarding the issuance of the notice of invalidation.
