¶ 15.74.01    Continuation-In-Part – Not Entitled To Benefit of Earlier Filing Date

Reference to this design application as a continuation-in-part under 35 U.S.C. 120  is acknowledged. Applicant is advised that the design claimed in the present application is not disclosed in the parent application. Therefore, the parent application does not satisfy the written description requirement of 35 U.S.C. 112(a)  or pre-AIA 35 U.S.C. 112, first paragraph, under 35 U.S.C. 120  for the design claimed in the present application and the present application is not entitled to the benefit of the earlier filing date. Because the present application is not entitled to the benefit of the earlier filing date of the parent application, the parent application is available as prior art under 35 U.S.C. 102  .
